02/17.09.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Lohsinghna P.S. Case No.08/2025, registered for the offence under Sections 115(2), 117(2), 118(2), 304, 126(2), 351(2) and 3(5) of the BNS, pending in the Court of the learned A.C.J.M., Hazaribag.

Learned counsel appearing for the petitioner submits that the petitioner has earlier moved before this Court in A.B.A. No.3395 of 2025, which was dismissed for non-prosecution and, thereafter, fresh anticipatory bail application has been filed.

Learned counsel for the State opposed the prayer and submits that once the anticipatory bail application was dismissed for non-prosecution, the petitioner was required to file proper petition for restoration of the said anticipatory bail application, however, the petitioner has again filed anticipatory bail application. She further submits that this practice must be deprecated.
5. The anticipatory bail application, which was earlier filed by the petitioner, was dismissed by another Bench and after change of roster of the

Bench, fresh anticipatory bail application has been filed that too in absence of any fresh ground. Admittedly, A.B.A. No.3395 of 2025 was dismissed for non-prosecution. The petitioner has not filed any Cr.M.P. for restoration of that application, however, fresh anticipatory bail application has been filed after change of the roster.
6. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, this application is dismissed.
