Saikia, learned counsel for the petitioner by placing reliance on the order dated 02-11-2025, passed by the Director of Secondary Education, Assam in compliance with the direction passed by this Court vide judgment and order dated 06-09-2024 in W.P. (C) No. 2776/2020 and W.P.(C) No. 6004/2022, submits that the selection process on being re-done, the review petitioner is now found to have scored more marks than the respondent No. 6. Accordingly, he submits that it is the review petitioner, herein, who would now required to be appointed as the Principal of the School in question. He submits that the respondent authority have not passed any consequential orders after issuance of Page No.# 3/4 the order dated 02-11-2025. He further submits that the review petitioner is staled to retire from his service on reaching the age of superannuation w.e.f. 30-11-2025. Accordingly, he submits that he would not be pressing this review petition in view of the order dated 02-11-2025 passed by the Director of Secondary Education, Assam but prays that the review petitioner be granted liberty to approach the respondent authorities for passing consequential orders, in pursuance to the determination as made in the said order dated 02-11-2025. The said prayer made by the learned counsel for the review petitioner is reasonable and accordingly, this Court proceeds to close the review petition being Review Petition No. 201/2025, granting liberty to the petitioner, herein, to approach the Director of Secondary Education, Assam for issuance of consequential orders in pursuance to the order dated 02-11-2025 passed by the said authority. Mr. S. Borthakur, learned counsel for the respondent No. 6 submits that he also be granted liberty to take appropriate steps for challenging the order dated 02-11-2025. It is provided that it is open to the either parties to take such steps for either compliance of the order dated 02-11-2025 and/ or to assail the same.
