JUSTICE PRAVEER BHATNAGAR Order 17/03/2025 1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- [2025:RJ-JP:11826] (2 of 3) [CRLMB-75/2025] petitioners have been arrested in connection with FIR No.12/2024, registered at Police Station Cyber Police Station (ATS & SOG) Jaipur, for the offence(s) under Sections 308(6), 318(4), 319(2), 111(4) and 204 of B.N.S. and Section 66-D of I.T. Act. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is argued that the accused-petitioners are relative of Tarun Verma. The accused-petitioners have not done any personal nor created any account. No mobile phones were recovered from the possession of the present petitioners, the petitioners were not connected with the other co-accused Naveen Temani. The accused-petitioners are in custody since 14.12.2024 and 15.12.2024, respectively, and the charge-sheet has already been produced and the trial of the case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail applications. It is contended that the accused-petitioners were found to be involved for the offence of cheating and they with the other co-accused cheated the complainant. The petitioners received the amount to their house, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case, considering the fact that the main allegations are not against the accused-petitioners, the charge-sheet has already been produced and there are no criminal antecedents against the accused-petitioners. The accused-petitioners are in custody since [2025:RJ-JP:11826] (3 of 3) [CRLMB-75/2025] long and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused- petitioners-1. Brijkishore Temani S/o Shri Harinarayan Temani and 2. Sohanlal Agarwal S/o Shri Mohanlal Agarwal, in connection with FIR No.12/2024, registered at Police Station Cyber Police Station (ATS & SOG) Jaipur, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
