This Revision has been preferred assailing the order dated 06.04.2024 passed by the Civil Judge, Class-II, District Sakti, whereby, the application preferred by the applicant/defendant No.1 under Order 7 Rule 11 of the CPC on the ground that the Civil Suit is barred by limitation, was dismissed. 2. Necessary facts of the case are that respondent No.1/plaintiff filed a Civil Suit for declaration of paternity that defendant No.1/applicant herein is his father. In the subject Suit, an objection has been raised that after attaining the majority, the Suit has not been filed within a period of 3 years, therefore, the Suit is time barred. 3. Having heard the submission of learned counsel for the parties and particularly considering the nature of the dispute about the paternity of the plaintiff, this Court is of the view that there is a continuing cause of action. 4. For the foregoing, this Court does not find any infirmity or illegality in the impugned order passed by the trial Court. 5. Resultantly, this Revision fails and is hereby dismissed.
