Petitioner has been made an accused in connection with Rengarih P.S. Case No. 06 of 2023, corresponding to POCSO Case No. 09 of 2024, registered under Sections 376(3) of the Indian Penal Code and Sections 4, 6 and 8 of the POCSO Act and chargesheet has been submitted under Sections 376(3) & 376(2) of the Indian Penal Code and Sections 4, 6 and 8 of the POCSO Act, pending in the Court of learned Special Judge (POCSO), Simdega. Petitioner is alleged to have raped 15 years old deaf and dumb girl due to which she become pregnant. Learned A.P.P. has opposed the prayer for bail and submitted that trial of the case is under progress. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail.
