Neutral Citation No. - 2025:AHC:38311 Court No. - 77 Case :- TRANSFER APPLICATION (CRIMINAL) No. - 149 of 2025 Applicant :- Rajendra Maurya Opposite Party :- State of U.P. Counsel for Applicant :- Vinay Kumar Tripathi Counsel for Opposite Party :- G.A. Hon'ble Manoj Bajaj,J. The applicant has filed this application under Section 447 of B.N.S.S. for transfer of Sessions Trial No.203 of 2022; titled : State Vs. Rajendra Maurya and others, arising out of Case Crime No.145 of 2021, Under Section 302/34 I.P.C., Police Station- Karma, District- Sonbhadra to any other competent Court in District Sonbhadra from the Court of Additional Session Judge-I, Sonbhadra, and further prayer to stay the proceedings of aforesaid case has been made. When the case is called, no one has appeared on behalf of the applicant. A perusal of the paper-book particularly the application moved by the applicant under Section 448 B.N.S.S. would show that the applicant-accused had expressed his apprehension that he may not get justice from the court where the trial is pending, which has reached at an advanced stage and the explanation of accused- applicant under section 313 Cr.P.C. already stands recorded. The application was considered by the District Judge, Sonbhadra and noticing the conduct of the applicant coupled with the fact that the trial has been directed to be expedited and concluded within specific time-frame by this Court, the District Judge, Sonbhadra
proceeded to dismiss the application. The application only expressing apprehension that the accused may not get justice is not supported with any instance or a convincing supportive material, therefore, it is clear that the applicant is making an attempt to delay the conclusion of the trial. The application is dismissed. Order Date :- 18.3.2025 Shiv Digitally signed by :- SHIV KUMAR SHARMA High Court of Judicature at Allahabad
