JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Lakahn Chandra Roy, Advocate For the JAC : Ms. Richa Sanchita, Advocate Ms. Suman Roy, Advocate ----- Order No.03 Date: 12.02.2025 1. The present writ petition has been filed for setting aside the letter no.JAC/Mad./1099/09-3544/23, dated 28th November, 2023 issued by the respondent no.2-Secretary, Jharkhand Academic Council, Ranchi, whereby the respondent no.7- Santu Sheikh has been nominated as the donor member of Madarsa Imadadul Uloom Chandrapara, Pakur. The petitioner has also prayed for quashing the letter no.JAC/Mad./1099/09-532/24, dated 10th February, 2024, whereby the respondent no.2 has approved the recommendation made by the respondent no.6 with respect to selection of respondent no.7 as Secretary of managing committee of Madarsa Imadadul Uloom Chandrapara, Pakur. 2. Heard learned counsel for the parties and perused the content of the writ petition. 3. It appears that the petitioner had earlier preferred a writ petition being W.P. (C) No.2869 of 2021 challenging the constitution of the managing committee of Madarsa Imadadul Uloom Chandrapara, Pakur constituted in the year 2020. The said writ petition was however not entertained due to the reason that the managing committee constituted in the year 2020 had already expired and the same was accordingly disposed of vide order dated 15th April, 2024. 4. Though the petitioner has challenged the letter no.JAC/Mad./1099/09-3544/23, dated 28th November, 2023 and the letter no.JAC/Mad./1099/09-532/24, dated 10th February, 2024, however, he has chosen not to challenge the notification as contained in letter no.JAC/Mad./1099/23- 2861/23, dated 13th September, 2023, whereby the managing committee of Madarsa Imadadul Uloom Chandrapara, Pakur has been reconstituted by the respondent no.2. Hence, in absence of any challenge made to the notification dated 13th September, 2023, the aforesaid prayer made in the writ petition cannot be entertained. 5. The writ petition is, accordingly, dismissed. (Rajesh Shankar, J.) Vikas/ -2- W.P. (C) No.6878 of 2024
