B E F O R E HON’BLE MR. JUSTICE SANJEEV KUMAR SHARMA ORDER 20.11.2025
Heard the learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor for the State. 2. This bail application has been filed by the petitioners namely, Mukut Ali, Aminul Islam and Md Jabid Khandab, under Section 483 of BNSS, 202, seeking for grant of bail, in connection with Manikpur P.S Case No. 113/2025, under Section 61(2)/196(2)/308(4)/308(5) BNS. 3. On 28.10.2025 one Innas Ali Talukdar, Sub-Inspector, Manikpur Police Station, lodged an FIR stating inter-alia that it has come to his knowledge that certain members of the organization called ‘Veer Lachit Sena’ have been involved in extorting money from several individuals, and also from other institutions and organizations by threatening them with grievous harm or death. It was also stated that members of the said organization have also extorted money from one Golap Hussain of village Patiladoha, hence, there is need for immediate action. Subsequently, the FIR was registered as Manikpur P.S Case No. 112/2025 u/s 61(2)/196(2)/308(4)/308(5) BNS. Page No.# 3/4
4. Thereafter, the police arrested the petitioners on 29.10.2025
5. Learned counsel for the petitioners submitted that the money allegedly recovered and produced by the police, stated to have been issued to one Golap Hussain, does not bear any signature, and moreover, petitioner No. 2 had joined the organization only in the month of September, 2025, and has no connection with the alleged extortion activities. 6.
Learned Additional Public Prosecutor, with reference to the case diary, submits that the victim has clearly implicated the petitioners, and there are sufficient materials to show that the petitioners were engaged in extortion activities. 7. On perusal of the CD, I find that the submissions of the learned Additional Public Prosecutor stand substantiated. 8. Having regard to the above, considering the gravity of the offence and the fact that the investigation is at a crucial stage, the prayer for bail stands rejected at this stage. 9. The bail petition stands dismissed. 10. Send back the LCR. JUDGE
