Through State Public Prosecutor, High Court ofA.P., Amaravati Respondent Petition under Section 482 of BNSS, 2023(Section 438 of Cr.P.C), is filed praying that in the cI'rCumStanCeS Stated in the memorandum Of grounds filed in support of the Criminal Petition, the High Court may be pleased to direct the Respondent-Police to enlarge the Petitioner/Accused No. 3 on bail in the event of her arrest in connection with crime No. 330/2014 of Arundelpet P.S., Guntur and to pass The petition coming on for hearing, upon perusing the petition and the memorandum of grounds filed I'n Support thereof and upon hearing the arguments of Sri SRIKANTH MATHINGI, Advocate for the Petitioner and of PUBLIC PROSECUTOR for Respondent, the Court made the following ORDER + The Court made the following: i-I ORDER: Dr. YLR, I Crl.P.No.7734 of 2025 Dated 21.O7.2025 The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity {the BNSS') by the petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.330 of 2024 of Arundalpet Police Statl'on, Guntur District, registered for the alleged offences punishable under Section 194 of the Bharatiya Nyaya Sanhita, 2023 (for brevitylthe BNS'). 2. The case of the prosecution is that a reportwas given by the son of the deceased, K. Sridevi, stating that she earlier worked in Swastik Seeds, Pattabhipuram, and later, she was staying idle without any work, and that due to financial exigencies, she borrowed Rs.5,00,000/-from her parents and also her elder sister, Vijaya Nirmala, and in fact, one Rudra Reddy lent that amount to them, and that thereafter, they all had been making phone calls, insisting and abusing her at the workplace, and because of all this stress, she made suI'CI-de attempts tO Clear the said debt, and that hl-s mother Sridevi was harassed by her boss as she could not clear the debt, and that before her SUI-CI'de, his mother Sridevi several times stated that her parents and elder sister used to tell her to Dr. YLR, I CrI.P.No.7734 of 2025 Dated 21.07.2025 die. On coming to know the same, he went to their house and found that his mother had sent a WhatsApp message that she was going to commit suicide and appeared drowsy, and when he questioned her, she reported that She had not made any attempt but was facing heavy discomfort. They took her to the Government Hospital. However, on 03.ll.2024 a{ about 3:30 A.M., as they noticed her at Arundelpet, she sent a selfie vI'deO Statl'ng that Nirmala, i.e., her sister, i.e., the petitioner herein, and Rudra Reddy are responsible for her death, and that she insisted she had no health issues and got them to return to their house.However, on 04.ll.2024 at about 8:00 A.M., she collapsed in the chair, and therefore, immediately they took her to the Government Hospital at about 10:00 A.M., and that because of the harassment of Vijaya Nirmala, who is the elder sister of the deceased, and Rudra Reddy, who lent the amount to her, she committed suicide.Basing on the said report, the above crime was registered, and however, whI-le taking treatment, she died. Thereafter, the investigating agency filed an Alteration Memo stating that initially the FIR was registered under Section 194 of ['the BNSS', and that later, the same was altered to Section 108 of lthe BNS'. Sri M.Srikanth, the learned counsel for the petI'tiOner, Submits that the petitioner has not committed any offence; he was falsely implicated in this case; he is the sole breadwI'nner Of his family; he iS ready {O abide any conditions to be imposed by this court; and urged to grant pre-arrest bail to the petitioner/Accused No.3. 4. Per confra, `Ms. P.Akila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bal'l stating that investigation is not yet completed; if the petitioner is granted pre-arrest bail, he will repeat the same offence and urged to dI-SmiSS the bail Petition. 5. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the petitioner/Accused No.3 is the mother of the deceased. The husband of the elder sister had given a loan to the deceased through the petI-tI'Oner. The petitioner is a female, aged about 69 years. In the present case, Accused Nos.1 and 2 have already been enlarged on bail by the learned X!I Additional District and Sessions Judge, Guntur, in crI.M.P.No.1235 of 2024, v,-de order dated 23.01-2025- \ =L= - \ Dr. YLR, I Crl.P.No.7734 of 2025 Dclted 21.07.2025 7. Considering the age of the petl-tjoner, her relation with deceased, gravity and nature of the allegations and the alleged role played by the Petitioner, this Court deems it fit to grant pre-arrest bail to the petitioner with the following conditions.I I-. ln the event of her arrest, the petitioner/Accused No.3 shall be enlarged on bail subject to she executing a Personal bond for a Sum Of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the sail-SfaCtiOn Of thearreSting POIice officials,- ii.
