PUBLIC PROSECUTOR The Court made the following: ...RESPONDENT/COMPLAINANT ORDER:- The Criminal Petition, under Section 482 of the Bharatiya Nagarik \ Suraksha Sanhita, 2023 [for short, ‘B.N.S.S’], is filed on behalf of the petitioner seeking anticipatory bail in connection with Crime No.687 of 2024 of Penamaluru Police Station, Krishna District, registered for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhitha (for short ‘BNS). Case of the prosecution, in brief, is that a report was given at 3.00 a,m on 16.07.2024 by the son of one Mr. M. Venkata Ramana Rao, wherein it is stated that Mr. Venkata Ramana Rao was working as the MPDO, Narsapuram from February, 2024 and he used to visit his own house in Kanuru during holidays, he applied for leave from 10.07.20024 to 20.07.2024 and came to his house in Kanuru. On 15.07.2024 when he was on leave, he informed his wife that he was going to Bandar, and again at about 3.30 p.m he made a phone call and informed that he was still in Bandar and he would come late. At 9.30 p.m, wife of said Venkata Ramana Rao tried to contact him over phone, but the calls were forwarded to the office of the MPDO at Narsapuram. At about 1.15 a.m in the midnight of 15/16.07.2024, a message was received to the phone of the informant from the phone of his father that it was his birthday and also death day and told to be alert. Hence, the report. 2. 3. Heard. Perused the record. On a perusal of record, it goes to show that the petitioner has not been shown as Accused in the subject crime. During the course of investigation, the Police have not shown the petitioner as an Accused till date. Learned Assistant Public Prosecutor for the State confirmed the factum that till date the name of the petitioner has not been shown as an accused. 4. Learned counsel for the petitioner submitted that there is a threat of arrest to the petitioner in connection wi^h the aforesaid Crime for the reason that the Police are visiting the house of the petitioner herein. 5. Keeping in view of the facts and circumstances, the Police are directed to issue 48 hours’ prior notice to the petitioner herein before taking any 6. coercive steps in the aforesaid crime. Accordingly, with the above observation, this Criminal Petition is 7. disposed of.
