The instant application under Section 528 of BNSS, 2023 has been filed by the applicant praying for a direction to the Additional Sessions Judge/Special Judge E.C. Act, Gorakhpur to frame charges in Session Case No. 208 of 2024 (State vs. Pramod Yadav) arising out of Case Crime No. 215 of 2022 under section 147, 148, 149, 307, 325, 504 I.P.C., Police Station Khajni, District Gorakhpur, Expeditiously within stipulated period. 3. Perusal of record shows that applicant is informant of the impugned F.I.R. and has only prayed for a direction to the Additional Sessions Judge/Special Judge E.C. Act, Gorakhpur to frame charges against the accused persons, as charge-sheet has already been filed in the instant matter on 26.07.2022. 4. Considering the prayer so made in the instant application, the application filed under Section 528 of BNSS, 2023 stands disposed of with direction to the Additional Sessions Judge/Special Judge E.C. Act, Gorakhpur to consider the matter pending before him, after submission of Charge- sheet, for framing of charges and decide the same expeditiously as early as possible, in accordance with law.
