For the Informant : Mr. Afaque Ahmad, Advocate 02/26.09.2025 Heard learned counsel for the applicant, learned counsel for the State and the learned counsel for the informant. 2. The instant bail application has been preferred by the applicant, who is in custody since 12.08.2025 in connection with Sariya P.S. Case No. 129 of 2025 registered for the offence under section 126(2), 115(2), 117(2), 118(1), 109(1), 352/3(5) of BNS, pending in the court of learned Judicial Magistrate 1st Class, Giridih. 3. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part. 4. Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. It has been submitted that as per the allegation, this applicant had used iron rod targeting head of the injured but the corresponding injury is on the shoulder of the injured. It is further submitted that the other co- accused namely Ramez Raja @ Ramez Alam, against whom there is allegation of inflicting head injury upon the injured, has been granted anticipatory bail in ABA No. 5490 of 2025 vide order dated 18.09.2025. 5. Learned counsel for the State has opposed the prayer for bail. Learned counsel for the informant has also opposed the prayer for bail and submitted that serious injuries have been caused by the applicant. 6. Considering the fact that vital part of the body of the injured 2025:JHHC:30273 2 B.A. No.8890 of 2025 has not been affected, I am inclined to enlarge the applicant on bail. 7. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Giridih in connection with Sariya P.S. Case No. 129 of 2025, subject to condition that the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
