The petitioner is claiming compensation for Arazi Nos. 49 and 53 Village Bagahi Bhari, Pargana Haveli, Tehsil Campiorganj, District Gorakhpur on basis of an award made under the provisions of the National Highways Act, 1956. The claim is based on an alleged gift deed in her favour by Sushila Singh w/o Surendra Pratap Singh. 2. Sri Mahendra Pratap, learned counsel for NHAI has placed on record the instructions received from the Authority and according to which the Authority has deposited the entire compensation amount in terms of the award with the Special Land Acquisition Officer/Competent Authority. 3. Learned Standing Counsel has placed on record the instructions received from the Competent Authority, according to which, some title dispute is in existence. 4. Having regard to the aforesaid stand, we dispose of the instant petition by providing that the Competent Authority shall examine the claim of the petitioner after due notice and opportunity of hearing to all concerned. The decision shall be taken within twelve weeks from the date of communication of the instant order. 5.
