The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 363, 366-A of IPC and u/s. 8 and 4 of the POCSO Act. 3. Learned counsel for the petitioner submits that petitioner is innocent and the victim girl in her statement u/s. 164 Cr.P.C. has clearly deposed that the petitioner had not kidnapped her; rather, they were friends and wanted to marry with each other upon which her family members disagreed. Ultimately, they flee away for solemnization of marriage. Learned counsel further submits that charge has been framed on 03.04.2024 and out of seven witnesses only one witness who is the victim herself has been examined; as such, there seems no likelihood of the trial being concluded in near future. He further submits that petitioner is languishing in custody since 28.11.2023; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court. 4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner. 5. Having regard to the facts of the case and looking to the period of custody as well as the statement of victim recorded u/s. 164 Cr.P.C.; I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Court, Jamshedpur in 2025:JHHC:30011 2 connection with Special POCSO Case No. 06 of 2024 (arising out of Kadma P.S. Case No. 153 of 2023). 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
