5. Looking into the contents of the FIR it transpires that Saurav Kumar has taken the name of the petitioner to the effect that the petitioner has handed over the motorcycle to sell and criminal antecedents are there against the petitioner, however, the petitioner has been granted regular bail in two of the cases and in one of the case the petitioner has been granted anticipatory bail and further the criminal antecedent cannot be only criteria to grant anticipatory bail or regular bail, however, that can be one of the criteria in allowing and rejecting the anticipatory bail or regular bail. The name of the petitioner has come on the confessional statement of one Saurav Kumar, who is the apprehended accused. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.
6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Chatra in connection with Huntergunj P.S. Case No.105 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
