Mr. Rana Mukherjee Ms. Suveni Banerjee … For the State Learned counsel for the petitioner submits that the petitioner is in custody for more than a year. The petitioner has no nexus with the alleged offence. None of the witnesses has named him as last seen together with the victim. Learned counsel for the State opposes the prayer. Bail prayer of the petitioner was turned down considering the material on record on two occasions. The petitioner absconded for three months after being directed to surrender before the learned trial Court within a stipulated time frame. The petitioner filed an application for anticipatory bail solely for the purpose of masking his abscondence. Trial has progressed sufficiently. 12 out of 19 witnesses have been examined so far. If the petitioner is released on bail at this stage, chances of his abscdonding which may delay the conclusion of trial cannot be ruled out. 2 Considering the material on record, prayer for bail is rejected at this stage. The application for bail is disposed of. Case diary be returned.
