State of U.P. has taken a decision to change the procedure of appointment of persons from outsourcing and by a recent communication dated 31.03.2024 the persons appointed through outsourcing by Principal of Colleges were set aside with a direction that now the appointments be made in accordance with earlier notification dated 28.10.2022. 3. Learned counsel for petitioners submits that petitioners were appointed through outsourcing, however, after aforesaid communication dated 31.03.2024 despite they are working, their salary has not been paid and it is not clear whether petitioners can still be considered in terms of aforesaid communication. 4. Learned Standing Counsel appearing for State-Respondents submits that petitioners can always apply as and when process for appointment through outsourcing is initiated in concerned collage and in order to streamline the appointments Government orders were issued. 5. In aforesaid circumstances, this Court is of the view that persons appointed through outsourcing have no indefeasible right to continue and petitioners have opportunity to apply as and when fresh recruitment is initiated in the collage. Therefore, this writ petition is disposed of with observation that petitioners will have liberty to apply as and when process for recruitment will be initiated in terms of above referred communication for appointment in concerned college.
