IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P(S) No. 5176 of 2024 Lalita Maji, W/o Subhash Chandra Ghosh, R/o Nijmandhara, PO: Laikapur, PS: Bagdehri, District Jamtara, Jharkhand … Petitioner(s) Versus 1. The State of Jharkhand. 2. The Secretary, Primary Education and Literacy Department, Govt. of Jharkhand, having its office at Project Building, Dhurwa, PO: Dhurwa, PS: Jagannathpur, District Ranchi, Jharkhand. 3. The Director, Primary Education and Literacy Department, Govt. of Jharkhand, having its office at Project Building, Dhurwa, PO: Dhurwa, PS: Jagannathpur, District Ranchi, Jharkhand. 4. The Deputy Commissioner, Jamtara, PO and PS Jamtara, District Jamtara, Jharkhand. 5. The District Superintendent of Education, Jamtara, PO and PS Jamtara, District Jamtara, Jharkhand. … Respondent(s) CORAM :SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Durga C. Mishra, Advocate For the Respondent(s) :Mr. Devesh Krishna, SC Mines III ...... 04 /21.01.2025: In this writ petition, the petitioner has prayed to allow the petitioner to participate in the counseling for appointment on the post of Assistant Teacher in BC-2 Female Category. The case of the petitioner is that the respondents have called her for counseling. There are four posts still vacant, therefore, the case of the petitioner should have been considered. The learned counsel for the respondents submits that the respondents have taken a decision not to fill up the posts, even the counseling was made only on the basis of the order of this Court. There was no cut-off marks and only the candidates who had obtained more marks than the last selected candidate were allowed to be recruited. The petitioner had obtained 48.74 marks and on perusal of entire merit list it is clear that there are more than 50 persons who had obtained more marks than the petitioner in the same category. From the arguments advanced on behalf of the parties, I find that there are four posts vacant in the category of BC-2 Female Category. As per the respondents there are at least more than four persons who have obtained more marks than the petitioner. As per the respondents the number is somewhere -2- between 50 to 100. Since more than fifty persons have got more marks than the petitioner, the petitioner cannot be appointed as there are more meritorious candidates than the petitioner. Thus I find that no relief can be granted to the petitioner in this writ petition and, hence, the same is dismissed. (ANANDA SEN, J.) KNR/-
