The petitioners challenge the registration of the crime for offences punishable under Sections 126(2), 115(2), 352, 351(2), and 324(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. The second respondent lodged an FIR stating that an altercation ensued between the complainant and the - 3 - NC: 2025:KHC:17362 CRL.P No. 6360 of 2025 petitioners, following which the petitioners assaulted, abused, and threatened the second respondent with dire consequences. 3. The parties are present before this Court and have filed an application for compounding, stating that they have amicably resolved the dispute among themselves. In terms of the settlement, the petitioners have handed over a demand draft for a sum of ₹1,50,000/- to the complainant towards the cost of damages to the vehicle. 4. Given that the parties have amicably resolved the dispute among themselves, it would be futile to subject the petitioners to investigation, as the probability of the police filing a charge sheet is remote and bleak in view of the settlement. In such circumstances, the continuation of the criminal proceedings would amount to an abuse of the process of law. ORDER i. Accordingly, petition is allowed. ii. The impugned FIR in Crime No.0078/2025 pending on the file of the 39th Addl. Chief Metropolitan Magistrate, Bangalore City is hereby quashed.
