JUSTICE A. GUNESHWAR SHARMA O R D E R 02-12-2025 [1] Present Mr. Kh. Tarunkumar, learned senior counsel assisted by Ms. Kh. Maria, learned counsel for the petitioner; Mr. Ramneek Mishra, learned counsel on video conferencing along with Mr. P. Tamphamani, learned counsel on behalf of respondent Nos. 1 & 2 (Cycling Federation of India); and Mr. Y. Robert, learned Dy. Government Advocate on behalf of State respondent Nos. 3 & 4. [2] The petitioner approached this Court aggrieved by the impugned notice dated 27-11-2025 issued by the Manipur Olympic Association on the intimation from Cycling Federation of India vide its letter dated 25-11-2025 requesting them to conduct trial selection for cyclists from Manipur to participate in “77th Senior, 54th Junior & 40th Sub-Junior National Track Cycling Championships” to be held at Rudrapur, Uttarakhand from 19th to 23rd December, 2025. [3] The matter was taken up yesterday, i.e. 01-12-2025 and on the WP(C) No. 946 of 2025 & MC(WP(C)) No. 876 of 2025 submission of Mr. Kh. Tarunkumar, learned senior counsel for the petitioner that intimation to Manipur Olympic Association for selection of Manipur team for Uttarakhand championship is arbitrary and without any basis. [4] During the course of hearing, Mr. Ramneek Mishra, learned counsel for Cycling Federation of India, has clarified that the said intimation letter dated 25-11-2025 was issued in bono fide belief that Manipur Olympic Association has been given charge of selecting team from Manipur during the pendency of WP(C) No. 227 of 2024 where the petitioner, herein, challenged the disaffiliation order issued by the Cycling Federation of India and interim order is operating staying the disaffiliation and the same is running till date. [5] Yesterday, Mr. Ramneek Mishra, learned counsel for respondent Nos. 1 & 2 (Cycling Federation of India), sought one day’s time to take instructions. [6] When the matter is taken up today, a copy of the letter dated 01- 12-2025 issued by the General Secretary, Cycling Federation of India to the Secretary, Manipur Olympic Association withdrawing the letter dated 25-11- 2025 regarding the conduct of the trial selection for Manipur cycling team. It is stated that the intimation letter dated 25-11-2025 was issued in misunderstanding the interpretation of order dated 14-11-2025 passed by this Court in WP(C) No. 227 of 2024. The letter dated 01-12-2025 issued by the Cycling Federation of India to Manipur Olympic Association is taken on record. With the withdrawal of the intimation letter dated 25-11-2025, the cause of the writ petition with respect to the 1st prayer has become infructuous. In the writ petition also, the petitioner seeks permission of this Court that the team selected on 05-11-2025 on the performance of the 4th WP(C) No. 946 of 2025 & MC(WP(C)) No. 876 of 2025 Governor’s Cup Manipur State Cycling Championship be allowed as Manipur team for the upcoming National Meet at Uttarakhand from 19th to 23rd December, 2025. [7] At this stage, Mr. Ramneek Mishra, learned counsel for Cycling Federation of India, has pointed out that Cycling Federation of India has issued direction to all State associations, federations and sport boards that National Championship or selection trial should be under the supervision of Observer appointed by the Cycling Federation of India and it is pointed out that in the last 4th Governor’s Cup organized by Manipur Cycling Federation, since no information was intimated to the National Federation of India, the Observer certified by CFI could not be sent. Regarding this, copies of the circulars dated 27-01-2021 and 23-08-2022 are placed before this Court. These circulars are also taken on record. In the alternative, it is prayed that a committee be appointed to select Manipur team for Uttarakhand Meet during the pendency of the writ petition. [8] Mr. Kh. Tarunkumar, learned senior counsel for the petitioner, submits that the petitioner-association is not aware about the circulars issued by the Cycling Federation of India. It is also pointed out that most of the officials of the Manipur Cycling Association are now in Orissa in connection with National Meet and it may not be feasible to have a selection trial in the short notice. It is also submitted that the last date of submission of the list of players is on 05-12-2025 and in the circumstances, it is proposed that the team selected by the Manipur Cycling Association from the performance of the 4th Governor’s Cup be allowed for this time and in future, the State association will intimate the National Federation in time about the upcoming tournament and the trial selection. WP(C) No. 946 of 2025 & MC(WP(C)) No. 876 of 2025 [9] Mr. Y. Robert, learned Dy. Government Advocate for the State respondent Nos. 3 & 4, submits that this Court may pass an appropriate order considering the interest of the players. [10] This Court has perused the material on record. It is submitted by the learned counsel for the Cycling Federation of India, the intimation letter dated 25-11-2025 requesting the Manipur Olympic Association to conduct a trial selection for Manipur team on 30-11-2025 as this Court in earlier occasion had constituted a Committee headed by Manipur Olympic Association. Since the intimation letter dated 25-11-2025 is withdrawn by the letter dated 01-12-2025 issued by the Cycling Federation of India, the cause of the writ petition has become infructuous. 39 players selected were sent by the order of Division Bench of this Court in the connected matter for Orissa Meet. [11] Mr. Ramneek Mishra, learned counsel for Cycling Federation of India, submits that out of these 39 players, 4 players are common, 17 are selected by Manipur Cycling Association and 18 by a committee headed by Manipur Olympic Association appointed by this Court. It is stated that out of the 17 players appointed by Manipur Cycling Association, 10 players did not participate and out of 18 players selected by Manipur Olympic Association, 6 players did not participate. It is submitted that non-participation of players from the selected players is a serious matter to be taken care and it is submitted that the team selected by Manipur Cycling Association for Orissa and Uttarakhand are almost same. [12] Mr. Kh. Tarunkumar, learned senior counsel for Manipur Cycling Association, submits that he will instruct the petitioner-association to send a full team for participation in Uttarakhand. WP(C) No. 946 of 2025 & MC(WP(C)) No. 876 of 2025 [13] Taking into consideration of this matter, this Court is of the view that for the Uttarakhand Meet, the team selected by Manipur Cycling Association on the performance of 4th Governor’s Cup be permitted to represent Manipur. However, Manipur Cycling Association is directed to inform all future tournaments and trial selections in time to the Cycling Federation of India so that authorized representatives be sent to oversee the tournament and the selection proceedings. [14] It is made clear that this Court passed this present order of sending a Manipur team to Uttarakhand Meet exercising extraordinary jurisdiction under Article 226 of the Constitution in order to meet the extraordinary situation and the same should not be pleaded as a precedent in future. Before concluding, this Court expressed appreciation of the fairness of the learned counsel appearing for the parties to resolve the dispute considering the interest of the game in general and the players in particular. [15] With this observation the writ petition is disposed of and MC(WP(C)) No. 876 of 2025 is closed. [16] Furnish a copy of this order to the learned counsel appearing for the parties in the course of the day by Whatsapp or any other available modes.
