ORDER \ This Writ Petition under Article 226 of Constitution of India i filed for the following relief: IS
“...to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents, more particularly respondent No.4 in not releasing the subsidy amount of Rs.8,80,000/- under the government schemes of Sub-Mission on Agricultural Mechanism (S.M.A.M.), Rashtriya Krishi Vikas Yojana (R.K.V.Y.), inspite of petitioner’s representation dated 18.10.2024, as illegal, arbitrary, unjust and violative of Articles 14, 21 and 300 A of the Constitution of India and consequently direct the respondents to release the subsidy amount of Rs.8,80,000/- under the Government schemes of Sub Mission on Agricultural Mechanism (S.M.A.M.) Rashtriya Krishi Vikas Yojana (R.K.V.Y.) schemes to the petitioner by considering the representation dated 28.10.2024 and to pass such other order or orders which this Court deems fit in the interest of justice”.
2. The case of the petitioner is briefly as follows:- The petitioner is a member of Sri Sai Baba Raitu Mitra Peddapuram, Gopalapuram Mandal, East Godavari Group, District. The group has been maintaining saving A/c.No.4010001011007069 in Vijaya bank of Gopalapuram. The respondent No.1 issued a rice harvest mission subsidy to the petitioner’s group in
/ , 3 f BSB,J W.P. No.18048 of2025 I.D.No.AP/chc/2018-19/1117. On 24.10.2024, the petitioner’s group paid an amount of Rs.26,91,270/- to the dealer Sree Surya Combine Harvester, Spares and General, but the dealer issued a bill only for Rs.23,30,000/- and thereby made a wrongful gain of Rs.3,31,270/-. The dealer did not open Sree Surya Combine Harvester, Spares, and General, Rajamahendravaram for a few days. It was informed to the respondent No.4 in Public Grievance Redressal System (P.G.R.S.). Further, there is no compliance of the report of the petitioner despite repeated requests. The amount of subsidy was also not released by the respondent No.1 to the petitioner. Thereby, the petitioner is suffering mental agony. Hence, this writ petition is filed.
3. The learned Assistant Government Pleader representing the respondents conceded for such disposal without going into the merits of the matter.
4. Accordingly, the writ petition is
disposed of directing the respondent No.4 to take a decision on the representation of the petitioner dated 18.10.2024, without any further delay, not later than one (01) month from the date of receipt of this order. There shall be no orders as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
