2. The respondents filed a counter in the writ petition contending that the land in question is classified as water course poramboke and grant of house site pattas in such land is not permissible. The counter also states that the appellants had been given 0.02 cents and 0.05 cents in Plot Nos.81 and 82 of Sy.No.186 of Nesanur village of Puttur Mandal on 14.08.2003. 3.
Learned Single Judge, after placing on record these contentions i : the counter affidavit, had dismissed the writ petition, by an
order, dated
23.02.2018. in
4. Aggrieved by the said order, the appellants have approached this Court.
5. Sri L.J.Veera Reddy, learned counsel for the appellants would contend that a survey had been directed by this Court, in the Writ Appeal and the same shows that, the land in question is only Railway poramboke land and not water course land, and as such, patta can be allotted to the appellants.
6. Learned Assistant Government Pleader disputes this contention and contends that the land in question is water course poramboke and pattas cannot be granted in this land. He would also submit that alternative land allotted to the appellants is now occupied and the same cannot be given to the appellants now.
7. Without going into question of nature of land in Sy No. 198/4 and 125/1 of Purttur Town and Mandal, it would be appropriate to notice that
3 € alternative sites had earlier been granted to the appellants and they are now occupied, by others. In such circumstances, this Writ Appeal is disposed of with a direction to the respondents No.1 and 2 to take steps to assign/allot house sites to ‘the appellants, in lieu of house sites which had been allotted in plot Nos.81 and 82 of Sy No.186 of Nesanur Village of Puttur Mandal.

9. Needless to say the appellants upon allotment of such land and being put in possession of such land, shall vacate the land, which is presently under their occupation. The said allotment should be completed within a period of four (04) months from the date of receipt of a copy of this order. There shall be no order as to costs.
10. As a sequel, pending miscellaneous applications, if any, shall stand closed. .
