1. By way of this writ petition, the petitioner has prayed for the following reliefs:-
“i. To kindly quash the impugned order dated 07/05/2025 (Annexure P/1) with respect to the transfer of petitioner from Sakti to district fund officer, Gorella- Pendra-Marwahi (C.G.) ii. To kindly give direction to the respondents to consider the posting of the petitioner at Bilaspur or nearby place. iii. To kindly direct the respondents to consider and decide the Digitally signed by MOHAMMAD AADIL KHAN
2 representation of the petitioner looking into the condition of the family of the petitioner. iv. To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case.”

Learned counsel for the petitioner would submit that the petitioner was placed under suspension on 28-08-2024 and his suspension order was revoked on 07-05- 2025 but instead of posting on his earlier place he has been posted at District Treasury at Gorella-Pendra-Marwahi. He prayed for posting of the petitioner on the same place from where he was suspended, i.e., Sakti, District Sakti.

On the other hand, learned counsel for the State opposes and has submitted that the petitioner has no right to claim to remain on the same place even after revocation of his suspension as has been held by the coordinate Bench of this Court vide order dated 18-01-2022 passed in WPS No.250/2022 (Ashwani Kumar Mire Vs. State of Chhattisgarh and others).
4. I have heard learned counsel for the parties and perused the material annexed with the petition.
5. As has been held by coordinate Bench of this Court in WPS No.250/2022 (Ashwani Kumar Mire Vs. State of Chhattisgarh and others) the petitioner cannot claim to be remained in the same place from where he was suspended and it is prerogative of the employer to fix the place of his posting in administrative exigency for which the petitioner was posted at District Treasury, District Gorella-Pendra- Marwahi, in which I do not find any infirmity to interfere by way of present writ petition. Accordingly, the present writ petition is dismissed.
6. However, the petitioner is at liberty to pursue his remedy through the representation before the competent authority.
