HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Writ Miscellaneous Application No. 330/2025 IN S.B. Civil Writ Petition No.8966/2025 Dr. Venkat Soni S/o Shri Goverdhan Soni Alias Vijay Soni, Aged About 34 Years, R/o Subhash Colony Shastri Nagar, Jaipur. At Present R/s F-112 Kardhani Scheme Kalwar Road Police Station Kardhani Jaipur Rajasthan. ----Petitioner Versus Smt. Komal Soni W/o Vankat Soni D/o Shri Chiranjilal Soni, Aged About 31 Years, R/o Mohan Market, Sodhani Ki Gali Ke Samne, Nani Gate, Subhash Chauk, Sikar, Rajasthan. ----Respondent For Petitioner(s) : Mr. Nikhil Soni Mr. Rohit Tiwari HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 28/07/2025 The instant misc. application has been filed on behalf of the applicant petitioner for modification/correction of the order dated 14.07.2025 passed in S.B. Civil Writ Petition No.8966/2025. Shri Nikhil Soni, learned counsel for the petitioner husband submits that as a matter of fact, the respondent wife filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal rights before learned Family Court, Sikar whereas inadvertently, in the order dated 14.07.2025, it has been wrongly recorded that “respondent filed a divorce petition under Section 9 of the Hindu Marriage Act before the learned Family (2 of 2) [WMAP-330/2025] Court, Sikar on 15.04.2023”. He thus, prays that same may be corrected and rectified. The prayer made for correction is justified. Accordingly, it is hereby directed that the submission recorded in the order dated 14.07.2025 that “respondent filed a divorce petition under Section 9 of the Hindu Marriage Act before the learned Family Court, Sikar (Raj.) on 15.04.2023” be replaced and read as “respondent filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal rights before learned Family Court, Sikar.” The application stands allowed. This order may be treated part and parcel of the order dated 14.07.2025. (ANIL KUMAR UPMAN),J GAUTAM JAIN /377
