Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2.The writ petition is filed with the following prayer: "1. Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 08.08.2024 passed by the Tehsildar Sadar Prayagraj / respondent No.4 Annexure No.1 to the writ petition. 2. Issue a writ, order or direction in the nature of mandamus directing the respondent no.4 to issue the Sadasyata Praman Patra to the respondent no.4 Tehsildar Prayagraj Sadar Prayagraj 3. Issue a writ order or direction in the nature of mandamus directing the respondent No.2 looking the above records may be release the family pension, gratuity, and other retiral benefits in favour of petitioner, as she is legally entitled being wedded wife of Zahid Husain R/o house no. No.219/95 D/ 33/1 Nai Chakiya Police - Station - Dhoomanganj, District – Prayagraj." Learned counsel for the petitioner submits that by means of the impugned order dated 08.08.2024, application of the petitioner for including her name in the family register has been rejected as the name of the petitioner being the wife of one Sahid Hussain has been found to be suspicious. 4. Learned counsel for the petitioner submits that evidence were produced, however, the same has not been accepted. 5. It is to be seen that inclusion of the name in the family register are summary proceedings. Petitioner has always a remedy of filing suit for declaration of status. 6. Accordingly, the writ petition is disposed of with liberty to the petitioner to approach the court of competent jurisdiction for declaration of her status. In the event, any such suit is filed, the impugned order shall abide by the decision in the suit.
