CORAM : SRI ANANDA SEN, J. For the petitioner(s) : Mr. Satyanshu Shubham, Advocate For the State : Mr. Vishwanath Roy, APP 05/13.06.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Hunterganj P.S. Case No. 57 of 2024, for the offences punishable under sections 427, 436, 504/34 of the Indian Penal Code, pending in the court of learned JMFC, Chatra. 2. Heard the learned counsel for the petitioner and the learned counsel for the State. 3. The learned counsel for the State opposes the prayer for anticipatory bail of the petitioner. 4. As per FIR, the cloth shop of the informant was set ablaze. The informant alleged that this petitioner who is his son-in-law is involved in the aforesaid crime. When the informant went to his shop he saw that the petitioner was fleeing in a motorcycle. 5. Though there is allegation against the petitioner that the petitioner was seen by the informant fleeing in a motorcycle near his shop but none of the independent witnesses have stated that they have seen this petitioner. The independent witnesses whose statements have been recorded in the case diary have stated that it is the informant or his son who have stated that they have seen this petitioner present there. In fact neither the informant nor his son have stated that they have seen this petitioner putting the shop on fire. 6. Considering the aforesaid facts and the contentions made in the case diary, I am inclined to release the petitioner on anticipatory bail. 2025 JHHC 15420 7. Accordingly, the petitioner, above named, is directed to surrender before the court below within three weeks from today and in the event of his surrender/arrest the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Chatra, connection with Hunterganj P.S.
