This bail application has been filed under Section 482 of the BNSS, 2023, praying for granting pre-arrest bail to the petitioner, namely, Rahul Khan, who is apprehending Page No.# 2/2 arrest in connection with Kokrajhar PS Case No. 131/2025, under Sections 303(2)/317(2)/317(2)/317(4)/313 of the BNS, 2023, read with Section 13(1)/16 of the Assam Cattle Preservation Act, read with Section 11(1)(d) of the Prevention of Cruelty to Animal Act, 1960. 4. The learned counsel for the petitioner has submitted that the petitioner is neither named in the FIR nor any recoveries have been made from him, but yet, when he went to enquire about the status of the case, the Police authorities have threatened him of arrest. 5. The learned Additional Public Prosecutor has submitted that on the statement of the accused, the petitioner was driving the motor cycle which belonged to the prime accused. 6. Since the petitioner has already appeared before the Investigating Officer in connection with Kokrajhar PS Case No. 131/2025, and his statement has been recorded, this Court is of the opinion that custodial interrogation or investigation may not be necessary at this stage. 7. In that view of the matter, the interim bail granted to the petitioner vide order dated 15.09.2025, is hereby made absolute. 8. Anticipatory Bail Application stands disposed of.
