Case No.151 of 2025 pending in the Court of learned SDJM, Jagatsinghpur, arising out of Balikuda P.S. Case No.43 of 2025 for commission of offence punishable under Sections 296/ 318(4)/ 351(2)/ 3(5) of BNS 2023. 3. Learned counsel for the State opposes the prayer. 4. Considering the nature of allegations, punishment prescribed, this Court has no iota of doubt that the authority shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, reported in (2022) 10 SCC 51. 5.
