Senior Secondary School, Bakara, Village And Post Bakara, District Jhunjhunu, Rajasthan Running By Society Noval Knowledge Public School Shiksha Samiti, Bakara, Jhunjhunu (Rajasthan) Through Its Principal Shri Ram Khichar S/o Shri Ram Karan, Aged About 57 Years, R/o Delsar Kalan, Jhunjhunu Rajasthan. ----Petitioner Versus 1. The Secretary, Board Of Secondary Education, Ajmer, Rajasthan 2. The Director (Academic) Board Of Secondary Education, Ajmer, Rajasthan 3. The District Education Officer, Secondary Education, Jhunjhunu, Rajasthan. ----Respondents For Petitioner(s) : Mr. Om Prakash Sharma JUSTICE ANOOP KUMAR DHAND Order 25/07/2025 1. The instant writ petition has been filed with the following prayer:- “It is, therefore, most respectfully prayed that by an appropriate writ, order or direction Your Lordships may kindly be pleased to accept and allow the writ petition and may given direction to the respondents to issue the permanent affiliation and unblocked the examination portal of the petitioner institution. Any other writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may also be passed in favour of the petitioner institution.” [2025:RJ-JP:27993] (2 of 3) [CW-11158/2025] 2. By way of filing this writ petition, the petitioner is seeking directions against the respondents to issue permanent affiliation and unblock the examination portal for petitioner-institution. 3. Learned counsel for the petitioner submits that temporary affiliation was granted to the petitioner, thereafter the petitioner applied for permanent affiliation by way of filing an application wherein certain information was sought by the respondents on 17.11.2023. Learned counsel submits that pursuant to the aforesaid notice dated 17.11.2023 issued by the Secretary, Education. Learned counsel submits that a detailed reply to the aforesaid notice along-with desired documents were submitted then and there only, but inspite of passing of more than one and a half year, till date no final order has been passed by the respondents on the application submitted by the petitioner for the reasons best known to them. Hence, interference of this Court is warranted. 4. Heard and considered the submissions made at the Bar and perused the material available on record. 5. Perusal of the record indicates that the application submitted by the petitioner seeking permanent affiliation is still lying pending for its adjudication on merits before respondents since the year 2023 and inspite of passing of considerable time, till date the respondents have not decided the same by passing the reasoned and speaking order. 6. Considering the above factual aspect of the matter, this Court deems it just and proper to dispose of the instant writ petition with directions to the respondents to make all possible endeavours to decide the application, as early as possible, [2025:RJ-JP:27993] (3 of 3) [CW-11158/2025] preferably within a period of 15 days from the date of receipt of certified copy of this order. 7. Before parting with this order, it is made clear that this Court has not issued any order/direction to the respondents to decide the application of the petitioner in a particular way. The respondents would be at liberty to decide the same strictly in accordance with law by passing a reasoned and speaking order. 8. Stay application as well as all applications (pending, if any) also stand disposed of. (ANOOP KUMAR DHAND),J Karan/32
