This is the second bail application under Section 439 of Code of Criminal Procedure filed by the applicant seeking enlargement on bail during trial in connection with Case Crime No. 127 of 2021, under Section(s) 302, 201 read with section 34 I.P.C. registered at P.S. Shahi, District- Bareilly. The first bail application of the applicant being Criminal Misc. Bail Application No. 33711 of 2022 was rejected by another Bench of this Court vide order dated 10.8.2022. 4. A perusal of the report of the trial judge dated 07.2.2024 goes to show that trial in the matter is pending and assurance was given that the matter shall be decided expeditiously. The report further shows that out of 22 witnesses, 11 witnesses have been examined in the trial. 5. Since there is no representation from the side of the applicant even in the revised list , the present bail application is dismissed for want of prosecution. 6.
