COMMON ORDER:
These two Criminal Petitions are disposed of by this common order as they arise out of one Crime/FIR. 2. The Criminal Petition Nos.5805 of 2025 and Criminal Petition No.7419 of 2025 have been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/A9 and petitioner/A6 respectively, for granting of pre-arrest bail in connection with Crime No.56 of 2021 of Bathalapalli Police Station, Anantapuramu, registered for the alleged offences punishable under Sections 403, 406, 420, 471, 120(B), 409 r/w 34 of IPC and Section 5 of A.P. Protection of Depositors of Financial Establishment Act, 1999. 3. The case of the prosecution, in a nutshell, is that A1 and A2, who are agents, and A3, who was manager in EBIDD Financial Traders Company, Anathapur took an amount of Rs.28,00,000/- from the defacto complainant and cheated him and failed to return back the amount. Basing on the complaint lodged by the defacto complainant, a case was registered against the petitioner and others. 4. Heard learned counsels for the petitioner/A9 (Crl.P.No.5805 of 2025) and petitioner/A6 (Crl.P.No.7419 of 2025) and the learned Assistant Public Prosecutor. Perused the record. 3
5. The learned counsel for the petitioners/A9 and A6 (Crl.P.Nos.5805 and 7419 of 2025) submits that the petitioners have not committed any offence and they were falsely implicated in this case. The petitioners would abide by any condition to be imposed by this court. 6. Per contra, Ms.
P. Akila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that the petitioners have indulged in the offence highhandedly, there is prima-facie case made out against the petitioners; some more material witnesses have to be examined; investigation is not completed; if the petitioners are enlarged on bail, they would not be available for the investigation and they would escape from the clutches of law; and urged to dismiss the bail petition. 7. The petitioners/A9 and A6, are arrayed as accused in this case based on the confession given by accused No. 12. The allegations against the petitioners are that they are agents of EBIDD Financial Traders Company, Ananthapur, which, through accused Nos. 1 to 4, collected money from the gullible public under the guise of promising to pay Rs. 30,000 as interest on every Rs. 1,00,000 deposited, thereby induced the people. The accused Nos. 1 to 4 have already been enlarged on bail. The learned Single Judge of this Court, in Criminal Petition No. 5646 of 2025, dated 27.06.2025, granted pre- arrest bail to accused No. 7. 8. The prosecution alleges that accused Nos. 1 to 15 collected nearly Rs. 1,62,00,000 from the gullible public by promising a high rate of interest, i.e.,

30% per annum, on deposits. So far, 50 witnesses have been examined by the investigating officer The learned Assistant Public Prosecutor submits that some more witnesses are yet to be examined. The petitioners are permanent residents of Ananthapuramu, and there is no possibility of they fleeing away from the clutches of the law. 9.
In view of the nature of the allegations leveled against the petitioners and the alleged roles attributed to them and the fact that A7 was already enlarged on pre-arrest bail, this Court deems it fit to grant pre-arrest bail to petitioner/A9 (Crl.P.No.5805 of 2025) and petitioner/A6 (Crl.P.No.7419 of 2025), subject to the following stringent conditions: a) In the event of arrest of the petitioner/A9 (Crl.P.No.5805 of 2025) and petitioner/A6 (Crl.P.No.7419 of 2025), the petitioners/A9 and A6 shall be enlarged on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only), each with two sureties for the like sum each to the satisfaction of the arresting police officials; b) The petitioners shall make themselves available for investigation as and when required; c) The petitioners shall not cause any threat, inducement or promise to the prosecution witnesses; d) The petitioners shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet. 5
e) The petitioners shall not leave the district limits without the express permission from the Station House Officer concerned. f) The petitioners shall surrender their passport, if any, to the investigating officer. If they claims that they does not have a passport, they shall submit an affidavit to that effect to the Investigating Officer. 10.
