Mr. Karnajit, learned counsel appeared on behalf of the appellant and Mr. S. Yaiskul, learned counsel appeared on behalf of the respondents No. 2 and 6. None appeared on behalf of the other respondents. It has been submitted by the learned counsel appearing for the parties that the present appeal was referred to the Mediation Centre, High Court of Manipur, for exploring the possibility of an amicable settlement. After holding a series of mediation proceedings, a settlement has been arrived at between the parties and as per the report submitted by the Mediator, a Deed of Agreement was made amongst the parties and the terms and conditions of the settlement as per the said Deed of Agreement are as under:-
“1) That, the Appellant/ First party namely Mrs. Shanghring @ Sajida and their Children who are the Respondent Nos. 2 to 6 except Respondent No. 3 shall entitle to receive the Death Benefits and other pensionary benefits entitled on demise of Late Abdul Gaffar. 2) That, all the members of the family shall allow to process in the name of Rspondent No. 6 namely Md. Tabrej for appointment under Die-in-Harness Scheme, Govt. of Manipur. 3) That, all members of the family shall allow to process for preparation of pension paper in the name of the Appellant for the death of her husband namely Late Abdul Gaffar. 4) That, the Appellant and the Respondents have agreed to close the RFA No. 7 of 2017 pending before the Hon’ble High Court of Manipur on the basis of present terms and conditions as agreed amongst the Parties. IN WITNESS WHEREOF the parties hereto have set and subscribed their respective signatures on the day, month and year first abovementioned.”
The learned counsel appearing for the parties submitted that as the dispute has been amicably settled amongst the parties as per the terms and conditions quoted hereinabove, the present appeal can be closed.
Recording the submissions made by the learned counsel appearing for the parties, the present appeal is hereby closed as per the terms and conditions quoted hereinabove. JUDGE Devananda
