PONNADA SREE VYAS Counsel for the Respondent/complainant(S): 1. PUBLIC PROSECUTOR 2. 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 7433/2025 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS, has been filed by the Petitioner/Accused, seeking to quash the order passed in Crl.M.P.No.2568 of 2019 in C.C.No.478 of 2015 on the file of the learned Special Magistrate Court, Amalapuram. 2. Sri Ponnada Sree Vyas, learned counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor for the State. 3. As can be seen from the record, C.C.No.478 of 2015, which is a very old matter on the board of the concerned Magistrate Court, wherein, Crl.M.P.No.2568 of 2019 has been filed by the complainant under Section 311 of Cr.P.C., seeking to mark the certified copy of the sale deed, copy of the report and the compromise letter executed by the accused dated 28.11.2018. That petition was allowed by the Magistrate Court. Aggrieved thereby, the accused/petitioner herein preferred the present petition seeking quashment of the order. 4. As can be seen from the impugned order, it is a well reasoned order. It is the complainant who wanted to file the certified copy of the sale deed dated 16.07.2025, copy of the report given to Amalapuram Town Police Station dated 25.07.2015 and the compromise letter executed by the accused dated 4 28.11.2018.The nature of these documents being public documents, there is no scope to create such documents. In that view, this Court does not find any reason warranting interference of this Court while exercising its jurisdiction under Section 482 of the Code. The Criminal petition is devoid of any merit. 5. In the result, the Criminal petition is dismissed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________ Dr. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 21.07.2025 UPS 5 HON’BLE DR.
