Heard Mr. A. Ahmed, learned counsel for the petitioners and Mr. H.R. Khan, learned counsel for the respondent no.2. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. 2. This application under Section 482 of BNSS, 2023 has been filed by the petitioners, namely, (i) Munjila Khatun and (ii) Saidul Islam @Saidul Badshah seeking pre-arrest bail in connection with Fakirganj PS Case No. 100/2025 under Sections 61(2)/64/351(2)/74 of BNS, 2023. 3. The allegation against the present petitioners, inter-alia, involves outraging the modesty of the informant by inducing her to have an illicit relationship with the petitioner No.2. 4. Case diary as called for has been received. 5. It appears that the FIR has been lodged almost one year after the alleged relationship between the petitioner no.2 and the informant, who is married lady, aged about 35 years. 6. It is also submitted that there exists political rivalries between the two parties. 7. Pursuant to the interim protection granted by this Court, the petitioners have appeared before the I.O and their statements have also been recorded. Page No.# 3/3 8. Having regard to the above as well as the nature of the material available in the case diary, the prayer for pre-arrest bail is allowed. 9. The order of pre-arrest bail dated 04.11.2025 is hereby made absolute subject to the conditions : i) That the petitioners shall continue rendering the co- operation to the investigation ; ii) That the petitioners shall not abscond; iii) That the petitioners shall not hamper or tamper with evidence. 10.
