GUNESHWAR SHARMA ORDER 04.11.2025 [1] Heard Mr. N. Ibotombi, learned sr. counsel assisted by Ms. Y. Jinita, learned counsel for the applicant and Mr. Y. Ashang, learned PP assisted by Mr. O. Ratankumar, learned Dy. GA for the State respondent no. 1 and Mr. W. Darakishwor, learned Special counsel for the respondent no. 2 (CBI). [2] By the present application, the applicant seeks leave of this Court to leave India w.e.f. 05.11.2025 to 28.11.2025 for attending Foreign Tour organized by Manipur Legislative Assembly for visiting Indonesia, Singapore and Malaysia. [3] At the outset, Mr. Y. Ashang, learned PP submits that State respondent is a proforma party and after the transferred of the case to CBI, the matter is between the applicant and the CBI. Vide common order dated 26.08.2019 in AB No. 11 of 2018 and connected matters, the applicant and others were granted anticipatory bail by this Court with the following conditions: a) All the Anticipatory Bail Applications are allowed. b) All the Petitioners are directed to be released on Anticipatory Bail on condition that each Petitioner should execute two OINAM THOIB A MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.11.04 17:22:02 +05'30' sureties of the like sum of Rs. 1,00,000/- each to the satisfaction of learned Special Judge, Imphal. c) The Petitioners are directed to appear before the Respondent Police as and when required for Investigation. d) The Petitioners are directed not to leave the Country without prior permission from this Hon’ble Court. [4] It is stated that the petitioner is one of the accused in FIR No. 5(3) 2018-V & ACPS U/S 420/120-B IPC & 13(2) R/W 13(1)(d) P.C. Act, 1988 and said FIR is in the investigation stage. [5] Mr. N. Ibotombi, learned sr. counsel for the applicant submits that in terms of clause no. ‘d)’ of the order dated 26.08.2019 in AB No. 11 of 2018, the applicant is required to seek permission of this Court for leaving the Country. On earlier occasion also, the applicant has been granted leave permission by this Court for leaving the Country on certain conditions and the last of such order dated 29.11.2024 passed by this Court in Crl. M.C. No. 39 of 2024 and the relevant portions is reproduced below: ”Accordingly, the applicant is permitted to leave India for his Foreign tour at Singapore and Malaysia from 08.12.2024 to 28.12.2024, however, it is made clear that the applicant/petitioner shall report in person before the Registrar General of this Court on 30.12.2024 without fail.” [6] Mr. N. Ibotombi, learned sr. counsel for the applicant submits that the applicant is the former Chief Minister of the State of Manipur and he will abide by all conditions imposed by the Court and similar order passed earlier may also be passed by this Court so as to enable him to join the foreign visit organized by Manipur Legislative Assembly. [7] Mr. W. Darakishwor, learned Spl. Counsel for the CBI submits that as in the earlier order, the applicant may be directed to report to the Registrar General on return to India. Page 3 of 3 [8] This Court has perused the materials on record and the earlier similar order passed by this Court. [9] In the circumstances, the application is disposed of by permitting the applicant to leave India w.e.f. 05.11.2025 to 28.11.2025 so as to enable him to visit Indonesia, Singapore and Malaysia as part of the foreign tour organized by Manipur Legislative Assembly. However, on return to India, the applicant shall report in person before the Registrar General of this Court within 1(one) week on return to the State without fail. [10] Accordingly, the Crl. M.C. No. 42 of 2025 is disposed of. [11] Furnish a copy of this order to the learned counsel appearing for the parties through Whatsapp/email. JUDGE Thoiba
