1. Accused No.2 in Crime No.10/2025 registered by Harohalli Police Station, Ramanagara, for the offences punishable under Sections 109(1), 118 and 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

FIR in Crime No.10/2025 was registered by Harohalli Police Station, Ramanagara, initially for the offence punishable under Section 109 of BNS, 2023, against four to five unknown persons based on the first information dated 10.01.2025 received from Thejas Gowda B S, brother of injured Vinay S. During the course of investigation, petitioner herein was arrested on 11.01.2025 and after completing the investigation, charge sheet has been filed against two persons. Petitioner is arraigned as accused No.2 in the charge sheet. Bail application filed by him before the jurisdictional Sessions Court in

Crl.Misc.No.5073/2025 was rejected on 05.03.2025. Therefore, he is before this Court.

Learned counsel for the petitioner submits that allegation against accused No.1 and the petitioner herein are similar in the charge sheet. Accused No.1, who was arrested along with petitioner has been granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.5122/2025 disposed of on
29.04.2025. Petitioner aged about 21 years, who has no other criminal antecedents is in custody for the last six months. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition however does not dispute the submission made by learned counsel for the petitioner. 6. FIR in the present case was initially registered against unknown persons. During the course of investigation, accused Nos.1 and 2 were arrested on 11.01.2025. After completing investigation, charge sheet has been filed against them for the aforesaid offences. The allegation in the charge sheet is that on the date of incident, injured Vinay who was working as

Secretary in a Company known as Phyrodynomics had objected for accused persons consuming alcohol near the premises of the company and it is in this background, accused Nos.1 and 2 had assaulted him with a weapon and caused grievous injuries to him. Accused No.1 as against whom similar allegations are found in the charge sheet has been granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.5122/2025 by order dated 29.04.2025. Undisputedly, petitioner has no other criminal antecedents. He is in custody from 11.01.2025. Therefore, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
7. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.10/2025 registered by Harohalli Police Station, Ramanagara, for the offences punishable under Sections 109(1), 118 and 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
