Agricultural Land (Conversion for Non- Agricultural Purpose) Act, 2006 (Act 3/2006), as amended subsequently rules issued in 2018 under G.O.MS.98 Andhra Pradesh Ordinance No. 7 of 2021 for the land admeasuring an extent of the balance of Ac.8.45.Cts in Sv.No.211-1 situated in Pedateenarla Revenue Village and Nakkapalli Mandal of Anakapalli District out of Ac.11.43 Cts., only Ac.2.98 Cts. were ratified/accorded on 17.12.2024 by the respondent No.3 in the same representation which is belongs to the same Sy.No, without any reason which is illegal, arbitrary, and violative of Articles 14, 21, and 300-A of the Constitution of India and pass Counsel for the Petitioner(S): 1. GP FOR REVENUE 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.19031 of 2025 ORDER:- Precisely, the writ petition is filed seeking a direction to the respondents to grant permission for conversion of agricultural land into non-agricultural purposes, in accordance with the provisions of the A.P.Agricultural Land (Conversion for Non-Agricultural Purpose) Act, 2006 (Act 3/2006), as amended subsequently and Rules issued in 2018 under G.OMs.98 & Andhra Pradesh Ordinance No.7 of 2021, for the land admeasuring an extent of the balance of Ac.8.45 cents in Sy.No.211-1 situated in Pedateenarla Revenue Village, Nakkapalli Mandal of Anakapalli District. Despite several representations submitted by the petitioners, no action was taken by the respondents. 2. Heard Sri M.Rama Reddy, learned counsel for petitioner and learned Assistant Government Pleader for Revenue for respondents. 3. Learned Assistant Government Pleader appearing on behalf of respondents submits that this Court vide docket order dated 06.08.2025, had directed the respondents to dispose of the representation dated 23.11.2024 submitted by the petitioners within a period of three weeks from the date of receipt of a copy of the order. In compliance, the said representation was disposed of by an order dated 25.08.2025 endorsing that the petitioners had not filed proper 4 applications under the A.P.Agricultural Land (Conversion for Non- Agricultural Purpose) Act, 2006 and Rules 2018. Hence, the petitioners are required to file fresh applications for conversion of the land. 4. Learned counsel for petitioners submits that petitioners may be permitted to file fresh applications for conversion, and seeks a direction to the respondents to consider the same. 5. In view of the above submissions, the Writ Petition is disposed of, permitting the petitioners to file fresh applications for conversion of the subject land. On such filing, the respondents are directed to consider the same and pass appropriate orders, in accordance with law. There shall be no order as to costs.
