Tamphamani, learned counsel for the petitioner and Mr. Niranjan Sanasam, learned Government Advocate for the State respondents through video conferencing. It is submitted that in the mediation proceeding dated 30-10-2025, the parties have mutually settled their disputes and the writ petition may be disposed of in terms of the settlement in the mediation proceeding. Mediation proceeding is reproduced below:— “HIGH COURT MEDIATION CENTRE, HIGH COURT OF MANIPUR Mediation Case No. 387 of 2025 W.P.(C) No. 347 of 2025 With MC(WP(C)) No. 322 of 2025 Hirom Brajendra Singh -Vs- State of Manipur & 2 Ors. As per the directions of the Hon’ble High Court of Manipur vide order dated 25/4/2025 in W.P.(C) No. 347 of 2025 with MC(WP(C)) No. 322 of WP(C) No. 347 of 2025 & MC(WP(C)) No. 322 of 2025 2025, and In pursuance of the Notification dated 26th August, 2025 issued by the High Court Legal Services Committee, High Court of Manipur, Shri. L Raju Singh, Advocate, has been appointed as the mediator to facilitate settlement between the parties. The parties have participated in the mediation proceedings before the Mediator and have reached a settlement of their disputes. BRIEF FACTS OF THE CASE 1. That the Agricultural land (Paddy field) under Patta No. 188 (old), 724/1723 (new) covered by C.S. Dag No.2324/1636 having an area of .62 acre, Phourel Class, situated at Village No.16-Heingang, Imphal East District, Manipur is recorded in the name of Late Hirom Ahanjao Singh who is the father of the Petitioner. The State Government had initiated the project/development program namely “Construction of Imphal Ring Road”. In the said acquisition process out of the whole area an area of 0.0636 acre is affected. The same has also been reported to the Deputy Commissioner, Imphal East by the SDO, Porompat, Imphal East vide letter No. SDO(IE)/P/10/Ring_Road/22 (Pt-II) dated 04-02-2025. However, due to non-payment of the compensation the petitioner filed the above referred W.P. (C) No. 347 of 2025 for payment of compensation. MEDIATION SETTLEMENT AGREEMENT This settlement Agreement is made and entered into on 30-10-2025 by and between Hiron Brajendra Singh (petitioner) and respondents in the referred W.P. (C) No. 347 of 2025. TERMS OF SETTLEMENT (i) The Respondents also admitted that an area of 0.0636 acre out of the total area of 0.2824 acre under patta No. 188 (old), 724/1723 (new) covered by C.S. Dag No. 2324/1636 having an area of .62 acre, Phourel Class, situated at Village No.16-Heingang, Imphal East Heingang Tahsil, which is recorded in the name of the petitioner’s father Late Hirom Ahanjao Singh which is presently in possession by the Petitioner is an affected land in the development/construction of Imphal ring road. However, in the earlier award, WP(C) No. 347 of 2025 & MC(WP(C)) No. 322 of 2025 the name of the petitioner/pattadar was not included in the list of affected pattadar. But in the subsequent resurvey report submitted by the SDC, Heingang, the name of the petitioner was included in the list of affected pattadars, consequently a corrigendum was issued for awarding compensation to the petitioner. (ii) After consideration, both the parties unanimously agreed that, the Respondents shall pay/release the entitled compensation amount of the said affected land to the petitioner as and when the funds are available. (iii) Further, both the parties unanimously agreed that, till the compensation amount is paid/released by the authorities to the petitioners, no development or construction work of the Imphal Ring Road shall be proceeded/executed in the said affected pattaland. (iv) That, both the parties unanimously agreed to dispose/close the pending W.P.(C) No. 347 of 2025 and connected MC(WP(C)) No. 322 of 2025 pending before Hon’ble High Court in terms of the mutual agreement arrived in the above (ii), (iii) & (iv) of the terms of settlement. (v) Both the parties further unanimously agreed that if the entitled compensation amount of the petitioner has been paid, by the acquiring authority there shall be no objection in the construction or development work of the Imphal Ring Road by the concerned work agency in the said affected land. (vi) The Respondents also undertake that, the agreement arrived at para (i) to (v) shall be informed by the Respodnents to the concerned works agency to comply the same to avoid any further complicacies. The parties acknowledge and confirm that they have read, understood and agreed to the terms and conditions of this agreement, without any coercion, undue influence, or duress and that their execution of this agreement is voluntary and intentional. The parties have executed this agreement on this 13th day of September, 2025 at the High Court Mediation Centre, High Court of Manipur.
