The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.129/2025, registered at Police Station – P.S. Cyber Branch District – Raipur (C.G.) for the alleged commission of offence punishable under Sections 317(2), 317(4), 317(5), 111(3), 3(5) of BNS.
2. As per the prosecution story, the Bank of Maharashtra, Raipur Branch, IFSC Code MAHB0000981 account no. 60474351779 is in the name of accused Jayant Ghosh, and mobile no. VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.06.19 17:36:22 +0530
2 7725035489 is registered with the bank account. Rs 03,02,21,710/- is deposited in the bank account on 30/11/2024 with respect to financial transaction of Rs 50,000/- with acknowledgment no. 20812240097800, complainant namely Gulafsha and one more has filed online complaint of cyber fraud.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He also submits that there is no material against the applicant in the entire case diary except the memorandum statement of the co-accused. He also submits that applicant was neither operating the bank account nor he was operating the mobile numbedr registered with the bank account. Therefore, he prays for grant of anticipatory bail to the present applicant.
4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant and submits that applicant has not criminal antecedent but looking to the overt-act applicant is not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts and circumstances of the case,
submissions of learned counsel for the parties, nature of dispute and material available in the case diary, it transpires that the present case is of the nature of online fraud, by which
3 the complainants suffered loss of huge amount, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail.

Accordingly, the anticipatory bail application of the applicant– Sanat Kumar Kurrey filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.129/2025, registered at Police Station – P.S. Cyber Branch District – Raipur (C.G.) for the alleged commission of offence punishable under Sections 317(2), 317(4), 317(5), 111(3), 3(5) of BNS is rejected.
