The case arises out of appointment of Multi-Purpose Health Assistant (MPHA) in West Godavari District, in pursuance of the recruitment process under taken by way of notification,dated 20.07.2022. There were various disputes relating to the selection of candidates. The details of the controversy do not require elaboration in as much as the main issue before the learned

SingleJudge was whether persons, within the same social category, with lesser marks than that of the petitioners had been appointed as Mutli-Purpose Heath Assistant in West Godavari District. A direction was issued for verification of the appointed candidates and to appoint the petitioners to such posts if it is found that the petitioners had more marks than appointed persons, falling within the same social category. 2. A large number of contempt cases came to be filed, on the ground that the said directions of the Court had not been complied with. All these contempt cases bearing C.C.No.1527 of 2023 and batch came to be allowed by a learned Single Judge of this Court, by an order dated
08.07.2024. The appellant herein, being aggrieved by the said order in C.C.No.2240 of 2023 has filed the present Contempt Appeal, contending that there is no candidate, with lower marks than that of the respondent, who had been appointed as a Multi-Purpose Health Assistant in West Godavari District in his social category. 3. Upon verification of the list, it appears that there is no person appointed as Multi-Purpose Health Assistant in West Godavari District, who has less marks than that of the respondent, in the relevant social category. 4. The learned counsel for the respondent, was also unable to point out any candidate who had been so appointed, even though the said candidate had obtained less marks than that of the respondent. 5.
In the absence of such a candidate, it has to be held that there was no violation of the direction of this Court. 3
6. Accordingly, this Contempt Appeal is allowed setting aside the order of the learned Single Judge, dated 08.07.2024, in C.C.No.2240 of 2023. As a sequel, miscellaneous petitions, pending if any, shall stand closed. _______________________ R.RAGHUNANDAN RAO,J
