The present application has been filed pleading willful disobedience of the order dated 26.09.2019 passed by this Court in Contempt Application (Civil) No. 6294 of 2019. It has been stated by the Standing Counsel that a compliance affidavit has been filed on 08.01.2024 in the office. However, the compliance affidavit is not on record. A copy of the said compliance affidavit has been handed over to the Court which is taken on record and shall form part of the record of the case. It has been stated in the affidavit that proceedings under Section 67 of the Uttar Pradesh Revenue Code, 2006 were instituted against five encroachers and eviction orders were passed regarding the encroachers. It has been further stated that in three cases, the encroachers have filed an appeal before the Collector, Tehsil Harraiya, District Basti and in the said appeal, eviction order has been stayed. One encroacher have already removed his encroachment and area occupied by the other encroacher has been included within the jurisdiction of the Nagar Panchayat, Harraiya. In view of the aforesaid, the order passed by the Writ Court has been complied by the opposite party and no further orders are required to be passed in the present contempt application. The contempt application is disposed of. The file of the case be consigned to records. Notice is discharged.
