ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for a Writ of Mandamus declaring the inaction of the official respondents on representation dated 25.06.2025, seeking police protection and appropriate legal action as illegal, arbitrary, illegal, biased, unconstitutional.
2 against the principle of natural justice, consequently, direct the official respondents to provide police protection during the course of the stitching operation of the thatched roof from the unofficial respondent and his as requested in Petitioners complaint dated 25.06.2025 ” men,
2. Sri Md.Farooq, learned Assistant Government Pleader for Home written instructions, would submit that the Police have not on received any representation from the Petitioner and in view of the civil disputes between the Petitioner and Respondent No.4, the Police never interfered with the same.
3. For ready reference, the written instructions are extracted hereunder: '‘2. It IS submitted that, as per the records of the 3rd Respondent police station re., Station House Officer, Devarapalli PS, East Godavari District no representation was received from the petitioner on 25.06.2025. After receipt of the present writ petition the 3rd Respondent made enquires. A fter due enquiry it is came to light that, the petitioner and 4th Respondent having civil disputes In respect of the same 4th Respondent filed the original suit on the file of Hon'ble Principal Junior Civil Judge, Kovvur vide O.S. No. 72/96. The said suit the Hon'ble Court was dismissed.
3. It is further submitted that, as the matter is purely related to the civil issues. The Respondent police never interfere with the civil issues, unless there is any specific direction from the Hon'ble Court. If there is any specific direction from the Hon'ble Court, the Respondent police will provide police protection/Police Aid."
4. Sri Ms.K.Akhila,
learned counsel for the Petitioner would submit, recording the same, the petition may be disposed of.
5. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to make a fresh representation to the Police and on receipt of such representation, the Police are directed to act according to governing rules and law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand Sd/- Wl. SRINIVAS ASSISTANT REGISTRAR closed.
