JUSTICE SANJEEV KUMAR SHARMA O R D E R 02.12.2025 Heard Mr. S.M. Abdullah, learned counsel for the petitioners. Also heard Mr. D.P. Goswami, learned Addl. Public Prosecutor for the State. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioners, namely, Jahed Ahmed @ Jahid Ali and Taufiq Ali @ Taufik Ali, praying for bail in connection with Basistha P.S Case No. 472/2025 registered under Sections 109/115(2)/117(2)/186(2) of BNS, 2023. 3. As per the allegation made in the FIR, on 11.09.2025, a quarrel broke out between the victim and his co-students. In the course of this quarrel, the present petitioners along with other co-accused persons assaulted the victim, as a result of which the victim became unconscious and subsequently died 20 days later in hospital. 4. This Court had perused the Case Diary on 26.11.2025 in connection with the earlier bail application being BA No. 3501/2025 and BA No. 3502/2025 on behalf of the present petitioners and had rejected the prayers for bail considering the incriminating material against the petitioners. 5. It is also submitted that releasing the petitioners at this stage would send a wrong message to society. Page No.# 3/3 6. On the other hand, the learned counsel for the petitioners has submitted that considering the length of detention of 76 days, the prayer for bail may be allowed. 7. Having regard to the heinous nature of the offence where a young boy from another State was severely beaten up by the accused alongwith several other persons resulting in his death, despite the length of detention, the prayer for bail stands rejected at this stage. 8.
