ORDER: The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioner, in connection with Crime No.21 of 2024 on the file of C.I.D Police Station, Mangalagiri, which was registered for the offences under Sections 409, 420 and 120-B read with 34 & 37 of Indian Penal Code and Sections 7, 7A, 8, 13(1)(b), 13(2) of the Prevention of Corruption Act.

Learned counsel for the Petitioner would submit that the Petitioner i an Accused in Crime No.21 of 2024 of C.I.D Police Station
Learned counsel would further submit that the Petitioner notice under Section 179 of BNSS from the IS not Mangalagiri. has received a concerned Police directing him to appear before the Police Officer, who is making investigation in the said on 07.07.2025, due to which, the Petitioner got apprehension that the Police may arrest him under the guise of the said notice. crime
4. Per contra, learned Senior Counsel for Respondent / State would submit that the Petitioner herein was called by the Police Officer, who is investigating the case, to examine him has a witness. It is submitted that the Petitioner is not an Accused in the said crime, as such the question of apprehension of arrest, does not arise at this juncture
Learned counsel for the Petitioner,
5. in reply, would submit that the Petitioner has been suffering from acute health issues relating to his kidneys, underwent surgery and is not in a position to attend before the Police Officer, at present.
6. Learned Senior Counsel for Respondent / State would further that, such being the case, the Petitioner is at liberty to inform the Police Officer, who is investigating the case, about his difficulty and the convenient submit
'W 3 date and time as per his choice since, he is only a witness relating to this case.

At his juncture, learned counsel for the Petitioner would submit that, recording the representation of the learned Senior Counsel for the Respondent / State, the petition may be disposed of by giving liberty to the Petitioner to make a representation to the Police Officer, who is investigating Crime No.21 of 2024 on the file of C.I.D Police Station, Mangalagiri, expressing his difficulty tp attend before him, due to his acute health issues. Considering the submissions, since it is represented on behalf of the State that the Petitioner is not shown as an accused in the present crime and he was called by the Police Officer, who is investigating the crime, as a witness only, the question of apprehension of arrest, at this juncture, does not arise.

In that view, the Criminal Petition is disposed of giving liberty to the Petitioner to make his submissions to the Police Officer, who is investigating Crime No.21 of 2024 on the file of C.I.D Police Station, Mangalagiri, expressing his difficulty to attend before him on the date which is specified in the notice. As a sequel thereto, miscellaneous petitions pending, if any, shall stand SD/- P.VINOD KUMAR ASSISTANT REGISTRAR closed.
