Petitioner Anmol alias Jagwinder Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 269 dated 30.12.2024 under Sections 108, 3(5) of Bharatiya Nyaya Sanhita, 2023 (earlier Section 306/34 of IPC) registered at Police Station City Kotkapura, District Faridkot (Annexure P-1). 2. As per facts of case, complainant Sadhu Singh father of the deceased victim gave his statement that his daughter Reena Kaur was married to Sonu Singh in the year 2015. Out of this wedlock, his daughter was having two sons; one five years old and another 03 years old. He had given dowry as per his status. Sonu Singh husband of Reena Kaur did not like her. About one year ago her daughter had gone to Mata Chintapurni (Himachal Pradesh) for Mundan ceremony of her son and on this Anmol alias Jagwinder Singh also accompanied the family. Her daughter disclosed this fact to her mother Binder Kaur. Her husband started quarreling with his wife all the more. Even sister of Sonu Singh namely Kaddu used to quarrel with his daughter. The victim was preventing Anmol alias Jagwinder Singh to visit her house. On the contrary, Anmol alias Jagwinder Singh started visiting the matrimonial house and used to stay with Sonu Singh. Finally, on 29.12.2024 at about 3:00 PM victim Reena Kaur committed suicide by hanging herself from the ceiling fan with the help of her dupatta and ended her life. Therefore, Sonu Singh, his sister Kaddu and Anmol alias Jagwinder Singh were responsible for her death. 3. Learned counsel for petitioner argued that this FIR has been lodged due to some misunderstanding. Present petitioner has no role in the entire occurrence. He referred to affidavits given by complainant Sadhu Singh and his wife Binder Kaur (Annexures P-3 and P-4) confirming that the misunderstanding has been cleared and they have no objection if the present petitioner along with others are granted bail. Even otherwise, petitioner is ready to join the investigation as and when required. It is prayed that his anticipatory bail petition may be allowed. 4. Bail petition is opposed by learned counsel representing State. It is pointed out that victim died unnatural death in the matrimonial home. The complainant had levelled specific serious allegations against the petitioner who interfered in the matrimonial life of the deceased victim. Regarding affidavits furnished by the complainant Sadhu Singh and his wife Binder Kaur, supplementary status report was called for in which it is reported that the misunderstanding was cleared and confirmed the giving of SUNIL DEVI 2025.07.08 17:18 I attest to the accuracy and integrity of this document CRM-M-8621-2025 -3- affidavits in favour of the accused mentioned in the FIR. It is further pointed out that another petition is also filed for quashing of FIR. 5. I have considered the aforesaid factual position. No recovery is to be effected from petitioner. Initially, when the FIR was lodged complainant Sadhu Singh (father of the deceased victim) levelled allegations against Sonu Singh, Kaddu and present petitioner Anmol alias Jagwinder Singh. Now at this stage, Sadhu Singh and his wife Binder Kaur have furnished affidavits (Annexures P-3 and P-4) in favour of the aforesaid accused named in the FIR. Petitioner is ready to join the investigation as and when required. So far as petition for quashing of FIR is concerned, the same will be decided on its own merits. Therefore, without expressing my mind on merits, anticipatory bail petition filed by petitioner Anmol alias Jagwinder Singh is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of BNSS, 2023. 6.
