Advocate Hon'ble Shri Justice Arvind Kumar Verma Order on Board 16/06/2025 Heard. 1. The present writ petition has been filed by the petitioners with the following relief(s) : “10.1. That, the Hon’ble Court may kindly be called for records of the compensation pertaining to the petitioner for kind perusal of this Hon’ble Court. 10.2. That, the Hon’ble Court may kindly direct the respondent authorities to compensate of those lands who are loosing of the petitioner, in the interest of justice. 10.3. Any other relief, which this Hon’ble Court may deemed just and fit in the facts and circumstances of the case.” 2. Learned counsel appearing for the petitioners submits that if all part of village Barbhata is dubbed to the Saradih Bairaj, then how is possible to some lands are un-dubbed in water area of Saradih Bairaj. He 3 further submits that the respondent authorities does not consider his representation is also showing that they act like a mechanically and his action is mala-fide. The petitioner loosed their lands for construction of Saradih Bairaj, so if petitioner is loosed their land in act of the State- respondent so that State is responsible for compensation. He further submits that till date, the respondent authorities have not decided the representation of the petitioners, therefore, it is prayed that the petitioners may be permitted to submit fresh representation before respondent authorities and in-turn concerned respondent-authorities may be directed to consider and decide the same at the earliest within specified time framed. 3. Learned State Counsel not opposes the limited prayer made by counsel for the petitioner. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering facts of the case, submissions of counsel for the respective parties, this writ petition is disposed of permitting the petitioners to submit fresh representation before the respondent authorities within '15 days' from today raising their grievances as raised in this writ petition. On making such representation, respondent-authorities are also directed to consider and decide the same, as expeditiously as possible as per relevant rules, regulations and law. 4 6.
