THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO|75 OF 2025 ORDER:- This Criminal Petition under Section 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), is filed seeking to enlarge the petitioner herein/A2 on bail in Crime No.95 of 2024 of RSASTF Police Station, Tirupathi registered for the offences punishable under Sections 49 and 61(2) of Bharatiya Nyaya Sanhita, 2023 (BNS), Section 20(1)(d) (i)(a) r/w 20(1)(c) (ii) of A.P. Forest Amendment Act, 2016. 2. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the Respondent-State. 3. Perused the record. 4. The crux of the prosecution case is that on o2.12.2024 in the reserve forest, near IIT College, Yeerpedu Forest Beat, Krishnapuram Forest Section, Yerpedu Mandal, Tirupati Range, the petitioner herein along with others have committed criminal conspiracy, abatement to commit the offence, criminal trespass into Reserve Forest without permission in order to cut red sander trees, in which, lnnova Car bearing NO.AP 16 BL 7992, Mahl-ndra Bolero Pickup Goods Carriage No.TN 36 AR 5740 were seized. On the <?zfzz? same day the petitioner herein and other accused i.e., A1, A3 to A14 were arrested. 5. Learned counsel forthe petitioner brOughttO the notice Of thiS court that the other accused i.e., A1, A3 to A5, A7 to All were already released on ba-ll by this court, vide orders dated 10.01.2025 'ln crl.p.No.76 of 2025 and prayed to grant bail tO the Pet'ltiOner herein. 6. ln the light of the above Circumstances, this Court is ®lnclined to grant bail to the petitioner/A2. 7. ln the result, the Criminal Petition is allowed with the following conditions'. (i) The pet'ltioner herein Shall be released On his execution a personal bond for Rs.10,000/-(Rupees Ten Thousand only) each with two sureties of for a like sum each to the satisfaction of the special court for Trial of Cases relating to Red Sanders Smuggling, Tirupathi; (ii) on such release, the petitioner/A2 shall appear before the stat'lon House Officer concerned Once in a Week i.e., On every sunday between 10.00 a.m. and 5.00 p.m., till filing Of Charge Sheet.
