1. Heard learned counsel for the Petitioner and
learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.271 of 2025 pending in the court of learned S.D.J.M., Khurda arising out of Khurda Town P.S. Case No.117 of 2025 for commission of offences punishable under Sections 61(2)/ 111(3)/ 223/ 293/ 303(2)/ 317(2)/ 329(3)/ 296/ 335/ 270/ 280/ 109(1)/3(5) of BNS, Section 21(1) of the Odisha Mines and Minerals (Development & Regulation) Act, Section 51 of the Odisha Minor Mineral Concession Rules, Section 15 of the Environment Protection Act, Section 39 of the Air (Prevention and Control of Pollution) Act and Section 139 of the Electricity Act.

Learned counsel for the Petitioner submits that taking into account the nature of allegations, custodial interrogation is not necessary. Hence, the Petitioner may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail.
5. Taking into account the nature of allegations and considering the submission made, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
6. Before releasing the learned Court shall verify as to whether order of this Court has been assailed before the Apex Court and if so, the result thereof.
7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
8. Accordingly, the ABLAPL stands disposed of.
9. Urgent certified copy of this order be granted as per rules.
