Heard Mr. L. Gogoi, the learned counsel for the petitioner and also heard Mr. B. Sharma, the learned Additional Public Prosecutor appearing on behalf of State respondent.

This is an application under Section 482 of the Code of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of pre-arrest bail to the accused/petitioner, who is apprehending arrest in connection with Tezpur P.S. Case No. 381/2022 (P.R. Case No. 916/2023) under Sections 420, 489(A) and 489(D) of Indian Penal Code.
3. It is submitted by Mr. Gogoi that the present accused/petitioner is innocent and he is no way connected with the alleged offence. Also, he is not an FIR named accused and he is not aware about the pendency of the case, nor police ever searched for him. He is accordingly shown as an absconder and now the learned Additional Chief Judicial Magistrate, Sonitpur, Tezpur had passed the
order of issuance of summons. However, the petitioner is ready and willing to appear before the learned Trial Court below and face the trial after he is provided with some kind of interim protection.

Mr. Sharma, the learned Additional Public Prosecutor submitted in this regard that the accused/petitioner is shown as an absconder as he never cooperated the I/O in the investigation of this case for which he is shown as an absconder. However, he submitted that the petitioner may approach the learned Trial Court below with a regular application for bail, which may be considered in accordance with law.
5. Hearing the submissions made by learned counsels for both sides it is seen that the accused is shown as an absconder and at present only summons is issued to the present petitioner directing him to appear before the learned Trial Court below.

6. However, considering the submissions made by learned counsel for the parties, the petitioner is hereby directed to appear before the learned Trail Court below within 10 (ten) days from the date of order with a regular application for bail, which may be considered in accordance with law. However, till 10 (ten) days from the date of order no coercive action shall be taken against the present petitioner.
7. In terms of above, this anticipatory bail application stands disposed of.
