This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.53/2025, registered at Police Station – Sarkanda District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 109 of the Bhartiya Nyaya Sanhita, 2023 and Sections 25 & 27 of Arms Act. As per prosecution story in brief is that the complainant Pradeep Kashyap lodged report at Police Station, Sarkanda to the effect that his elder sister (injured) was living in relationship with the applicant at Bangalipara, Sarkanda. On 10.01.2025 at about 8.00 PM, the injured called the complainant through phone and informed that the applicant is assaulting with her. On the basis of said information, the complainant along with his younger sister went to the place of incident, where he came to know that the injured has been sent to CIMS Hospital, Bilaspur for treatment, upon which, the complainant went to CIMS Hospital for treatment of his sister (injured) and the injured informed that the applicant has assaulted with her with the help of knife. On the basis of said report, the alleged offences have been registered against the applicant.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits the applicant and injured were having love relationship and they were living together since 8-9 months and the incident took place in a grave and sudden provocation and injuries found over the body of the injured were simple in nature and she cured. He further submits that the charge has already been filed and the trial will take considerable time for its conclusion, therefore the applicant may kindly be released on bail, therefore, he prays for releasing the applicant on regular bail.
4. On the other hand, learned State counsel as well as learned counsel for the objector opposed the bail application of the present applicant and submits that the applicant assaulted the complainant due to which
3 she suffered18 grievous injury over her body, therefore, the applicant is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the nature of the allegations levelled against the applicant, and the fact that the victim, who is a major girl and was in a consensual relationship with the applicant but their relationship could not materialize and further, the applicant assaulted the complainant/victim due to which she suffered 18 grievous injures over her body, therefore, I am not inclined to grant regular bail to the applicant.

Accordingly, the anticipatory bail application of the applicant – Sanad Kashyap, involved in Crime No.53/2025, registered at Police Station – Sarkanda District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 109 of the Bhartiya Nyaya Sanhita, 2023 and Sections 25 & 27 of Arms Act, is rejected.
